Eva Schueller

Eva Schueller, known to her clients and friends as Evi, has spent almost fifteen years representing financial institutions, companies, and individuals as they navigate their thorniest complex commercial litigation and investigation matters. She has handled cases for brand-name companies in a diverse range of industries, including technology, telecommunications, cryptocurrency, consumer goods, food and beverage, and real estate. She has also represented federal, state, and local governmental bodies. Evi has a proven record of success in federal and state trial and appellate courts and before various arbitral and multilateral forums.

Before joining Illovsky & Calia LLP, Evi worked at the global law firm DLA Piper LLP, managing high stakes and high-profile litigation and investigations. Her prior experience includes serving as Counsel to the Assistant Attorney General of the Civil Division for the United States Department of Justice, where she was involved in the department’s health care fraud civil recovery efforts, reviewed the constitutionality of the Defense of Marriage Act, and assisted with DOJ’s investigation of the role ratings agencies played in the 2009 financial crisis. She also spent two years as a Deputy County Counsel for the County of Alameda, representing county agencies in litigation involving a variety of constitutional and statutory claims, as well as providing guidance on a wide range of compliance issues. Evi began her legal career at Morrison & Foerster LLP, where she defended corporations and individuals in securities class actions and in criminal matters involving allegations of wire and financial fraud, unauthorized use of data, and campaign finance violations.

Evi is known for her strategic approach to legal problem-solving and her ability to effectively communicate complex legal concepts to clients. She prioritizes learning about a client’s business operations and specific needs and is committed to providing practical and efficient solutions to meet those unique needs. Evi brings a fresh perspective to client problems, rooted in a broad and unique range of experience. In addition to her experience serving clients in law firms and at government agencies, she worked for several years as a legal consultant for a human rights organization in Cambodia, where her role included supporting Cambodian attorneys in preparing submissions to international tribunals and conducting supply chain and cross-border labor trafficking investigations. Evi has also served as a volunteer mediator in Alameda County. Evi has native fluency in Hungarian and speaks Spanish.

Commercial Litigation

  • Defended a technology company in multidistrict litigation challenging the legality of certain apps. Obtained interlocutory appellate review of complex Section 230 issues.
  • Defended a prominent cryptocurrency exchange in multiple individual and class action lawsuits in federal and state courts involving contract, tort, and statutory claims. Successfully compelled arbitration in each case where sought.
  • Defended a technology company in a data privacy class action in federal court that involved issues related to voice recognition and artificial intelligence software.
  • Represented a major cell phone carrier in federal court litigation and state enforcement proceedings involving challenges to the constitutionality and enforceability regulations.
  • Represented a national agronomic solutions provider in contract dispute with municipality.
  • Represented a national hotel chain in contractual indemnity dispute with a municipality.
  • Represented a global consumer goods company in antitrust litigation in federal court, including managing voluminous cross-border e-discovery efforts.
  • Represented a multinational financial services and insurance company in a substantial insurance coverage dispute.
  • Obtained summary judgment on behalf of a large insurance company in a coverage dispute involving claims related to groundwater contamination.

  • Represented global oilfield services company in Foreign Corrupt Practices Act investigation by federal regulators.
  • Represented digital currency company in internal investigation of potential compliance breaches by executive.
  • Represented cryptocurrency exchange in internal investigation of data and security controls.

Federal and State Appeals

  • Defended a national retailer in a lawsuit challenging the enforceability of co-tenancy provisions in commercial leases. Secured summary judgment in the trial court and protected that judgment on appeal.
  • Represented pro bono client in appeal involving the provision of medical services in California state prison. Obtained reversal in part by the Ninth Circuit.   
  • Represented real estate company in appeal involving various contract and tort claims related to the sale of a large commercial building in San Francisco’s financial district.
  • Prepared amicus brief to U.S. Supreme Court on behalf of popular online platform in case involving the scope of immunity under Section 230.

International and Domestic Arbitration

  • Secured a complete defense award with attorneys’ fees for a cybersecurity firm in a licensing dispute.
  • Represented a global wine distributor in international arbitration involving a contract dispute with multiple cross-claims and parties on three continents.
  • Defended the developer of a luxury resort in Napa Valley in domestic arbitration involving contract and tort claims; obtained full defense award.
  • Defended cryptocurrency platform in multiple consumer arbitrations.
